These Terms and Conditions (“Terms”) govern your use of the Evergreen help centre audit tool (“the Service”), available at evergreen.help. The Service is operated by Denis Mallon, trading as Evergreen (“we”, “us”, “our”).

By submitting a URL to the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.


1. The Service

Evergreen provides an automated audit of publicly accessible help centre content. You submit a help centre URL and, optionally, release notes or other context. The Service crawls the submitted URL, analyses the content, and returns a report identifying potential gaps, outdated content, and multilingual issues.

The Service is provided in two tiers:

  • Free tier — available to all users at no cost, subject to these Terms
  • Paid tier — additional features and usage are available under a paid plan. Paid tier terms, pricing, and conditions will be presented to you at the point of upgrade and form part of these Terms

2. Eligibility and permitted use

You may only submit URLs that you own or are authorised to audit on behalf of the domain owner. Submitting a URL that belongs to a third party without their explicit permission is strictly prohibited.

By submitting a URL, you confirm that:

  • You are the owner of the domain, or have explicit authorisation from the domain owner to submit it for analysis
  • You are using the Service for lawful purposes only
  • You are at least 18 years of age, or are accessing the Service on behalf of an organisation

We reserve the right to suspend or terminate access to the Service for any user we reasonably believe is in breach of this clause.


3. Advisory nature of reports

Reports generated by the Service are provided for informational purposes only. They represent an automated analysis of publicly available content and should not be treated as definitive or exhaustive assessments.

We make no warranty that reports are accurate, complete, or suitable for any particular purpose. Any decisions you make based on the content of a report are made at your own discretion and risk. Evergreen accepts no liability for actions taken or not taken in reliance on a report.


4. Crawling and data collection

By submitting a URL, you consent to Evergreen crawling the publicly accessible pages of that domain for the purpose of generating your report. We crawl only pages that are publicly available and do not attempt to access password-protected or otherwise restricted content.

We do not store the content of crawled pages beyond what is necessary to generate and deliver your report. Report data is retained for up to 180 days, after which it is deleted.


5. Intellectual property

The Service, including its software, design, and output format, is the intellectual property of Evergreen. You may use reports generated for your own internal purposes but may not resell, redistribute, or represent them as your own independent work.

You retain all rights to the content on your help centre. By submitting a URL, you grant Evergreen a limited, temporary licence to access and analyse that content solely for the purpose of generating your report.


6. Availability and changes to the Service

We aim to provide the Service on a continuous basis but do not guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice.

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.


7. Limitation of liability

To the fullest extent permitted by law, Evergreen shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or reputational damage.

Our total liability to you in connection with the Service shall not exceed the amount paid by you to Evergreen in the 12 months preceding the claim. For free tier users, this limit is nil.


8. Governing law

These Terms are governed by the laws of Scotland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Scottish courts.
